Assalamu Alaikum.Should a Muslim who is also a revert accept a family inheritance if the family member(mother)who left the inheritance was christian ?

Answered by Shaykh Abdurrahmann Murad

Assalamu Alaikum dear brother,

In relation to your question, let me relate to you the following Hadeeth:

The Prophet, may Allah exalt his mention, said: "A Muslim shall not inherit from a non-Muslim and a non-Muslim shall not inherit from a Muslim." (Authentic - Sahih al-Jami)

The majority of scholars view that this textual evidence is to be taken at face value; thus a Muslim may not take any inheritance assigned to him from a non-Muslim's estate.

The second view, which is a minority opinion, states that a Muslim may inherit from a non-Muslim; they interpret the Hadeeth above by stating that the prohibition applies only to inheriting from a non-Muslim who is physically at war with Muslims. This view is the opinion held by Mu' adh bin Jabal, may Allah be pleased with him, and other Companions. It is also taken by a number of Tabi'ee and is also the accepted viewpoint of Shaykh ul-Islam, Ibn Taymiyah, may Allah have mercy on him. (Ahkaam Ahludh-Dhimmah)

Personally, I view the second opinion to be stronger; however just to be on the safe side, you can simply ask your non-Muslim relative to gift whatever it is that they want to give you. That way, you would avoid the implications of this difference of opinion.
